These Terms of Service ("Terms") govern your access to and use of https://thetoptechjobs.com and related services. TheTopTechJobs is a product of Boolean and Bean Pty Ltd, an Australian private company based in Victoria, Australia. In these Terms, "we," "us," and "our" refer to Boolean and Bean Pty Ltd. By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service is provided and operated by Boolean and Bean Pty Ltd. TheTopTechJobs is a product name and is not a separate legal entity.
TheTopTechJobs is a job discovery platform for niche US tech roles. We aggregate listings from third-party sources and employer career sites. We are not your employer, recruiter, or agent. Applying for a job is solely between you and the employer.
You must be at least 18 years old and able to form a binding contract. If you are under 18, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms. You may not use the Service where prohibited by law.
You sign in with a one-time email link. You are responsible for access to your email account and for activity under your login. Notify us at hello@thetoptechjobs.com if you suspect unauthorized access.
Account features such as saving jobs and searches may be available without a Professional subscription. The current features included in each plan are shown before purchase.
We may change features, markets, or freshness rules with reasonable notice when changes materially affect paid subscribers.
Paid plans are billed through Stripe. Before checkout, we show the subscription price, currency, billing frequency, and material plan features. Current list prices are also shown on the Pricing page. Prices may change for future purchases or renewal periods, but we will give reasonable advance notice of a material price change where required by law.
By starting checkout, you authorize Stripe to charge your payment method on a recurring basis according to the plan you select.
Optional weekly digests summarize new listings for a market you choose. By signing up, you expressly consent to receive those messages at your account email. We record the subscription request so we can operate the digest and demonstrate consent. Each digest identifies us as the sender and includes a direct unsubscribe link that does not require login. You can also manage digests from your account or contact us. We action unsubscribe requests promptly and within five working days. Do not sign up other people without their permission.
Subscribers may create API keys to connect AI tools to our MCP server. Keys are personal to your account. You must keep keys secret and not resell access. We enforce daily and monthly call limits and may suspend keys that abuse the Service or violate these Terms.

We may suspend or terminate access for violations.
You may stop using the Service at any time. You may request account deletion by emailing hello@thetoptechjobs.com from your account email. Deletion does not automatically cancel an active Stripe subscription, so cancel billing first through the account portal or ask us to help. We may suspend or terminate access where reasonably necessary to address fraud, security risks, non-payment, unlawful conduct, or a material breach of these Terms. Where practicable, we will give notice and a reasonable opportunity to address the issue.
We may add, remove, or change features as the Service develops. If we discontinue the paid Service or remove a core paid feature during your current billing period, we will provide a reasonable remedy, which may include continued access, a replacement feature, cancellation, or a proportionate refund, subject to applicable law.
Listings may be delayed, incomplete, or withdrawn by employers without notice. Apply links may redirect to third-party applicant tracking systems. We do not guarantee interview, offer, or compensation outcomes. Your use of employer sites is governed by their terms.
Boolean and Bean Pty Ltd owns or licenses the Service branding, design, and software. Job content belongs to respective employers and licensors. You receive a limited, non-exclusive license to use the Service for personal job search.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where a statutory guarantee applies, your remedies are determined by the applicable law and may include cancellation, a refund for an unused portion, or compensation for reasonably foreseeable loss or damage.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Boolean and Bean Pty Ltd AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) US $50.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
To the extent permitted by law, you are responsible for reasonably foreseeable loss we incur as a direct result of your unlawful misuse of the Service or your material breach of these Terms. You are not responsible to the extent the loss was caused or contributed to by our negligence, breach, or willful misconduct.
These Terms are governed by the laws of Victoria, Australia, without excluding consumer guarantees, privacy rights, or other protections that cannot lawfully be excluded. Where permitted, the courts of Victoria, Australia have non-exclusive jurisdiction over disputes relating to these Terms or the Service.
We may modify these Terms. We will post updates on this page and adjust the "Last updated" date. Where reasonably practicable, we will give advance email or in-product notice of a material change that adversely affects paid subscribers. Continued use after changes become effective constitutes acceptance. If you disagree with changes, cancel your subscription and stop using the Service.
